Judgment on Jago Case

Tor 3/2553 February 25, 2010 Subject: Notification of the Supreme Court's Judgment on Lawsuit Between Jago Co., Ltd. and The Government Lottery Office To: President The Stock Exchange of Thailand Loxley Public Company Limited ("the Company") was reported from Jago Company Limited ("Jago"), a subsidiary of the Company, that on February 24, 2010, the Supreme Court issued a judgment on lawsuit between Jago and the Government Lottery Office ("GLO"), decided case no. 3672/2547. The conclusion was that the contract appointing distributor and distribution of online charity lottery between GLO and Jago fell under the Public-Private Joint Venture Act B.E.2535. However, GLO did not follow the rules and procedures of such act, the contract appointing distributor and distribution of online charity lottery then has non-contractual effect to the government and the other party. In addition, the arbitration settlement agreement which was a part of this agreement was considered invalid. Therefore, the Supreme Court has overturned the Civil Court's judgment. The case is final and GLO has not to compensate Jago as the verdict of the arbitrators and the Civil Court. Please be informed accordingly.
