No Participation in 3G Frequencies Auction

Tor 10/2553 30 August 2010 Subject: No Participation in 3G Frequencies Auction To: The President The Stock Exchange of Thailand According to news broadcasted that Loxley Public Company Limited ("the Company") would like to participate in Spectrum Licensing for IMT mobile phone service in the frequency band of 2.1 GHz auction (3G) with the National Communications Commission ("the NTC"). The Company would like to update that the Company considered not participating in the licensing due to: 1. Condition of Guarantee It is required that any entrepreneur who would like to apply for the licensing has to provide cash or bank cheque for 10% of the auction value which has minimum value Baht 12,800,000,000 (or equal to Baht 1,280,000,000 for the guarantee). It is considered as a high amount, and the Company is not prepared to provide such high guarantee. 2. Bid Submission Period If counting from the meeting date to the bid submission date, it is considered as a very short period compared to the project value; other projects usually offer longer period than this. Therefore, the Company is not ready to participate in the auction as scheduled time. Please be informed accordingly.
